1. About these Terms
These Terms Of Use (the “Terms”) govern access to and use of weathera.co and its weather information, charts, articles, summaries and weather-related wellbeing signals (together, the “Service”). The Service is provided under the Weathera name (“Weathera”, “we”, “us” or “our”).
The Service is currently available free of charge. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy separately explains Weathera’s privacy practices. It does not form part of these Terms.
2. What Weathera provides
Weathera presents current and forecast weather, historical observations, air-quality information and general explanations about possible relationships between weather and wellbeing. The Service may combine third-party data, automated calculations, rules, statistical estimates and editorial content.
Wellbeing signals describe general weather patterns for a city, place and time. They are not generated from a visitor’s personal health information and are not personalised for an individual visitor.
The Service is provided for general information, education and personal planning only. It is not intended for aviation, marine navigation, emergency management, disaster response, workplace safety, insurance, trading or any other purpose where inaccurate or delayed information could cause injury, loss or damage.
The Service is experimental and may change as its data sources, methods and presentation are improved.
3. Medical and health disclaimer
Weathera is not a healthcare provider, medical device or emergency service. Weather-related wellbeing signals are general informational indicators for a place and time. They do not use a visitor’s personal health information and do not determine whether a particular person will experience migraine, headache, pain, fatigue, sleep problems, mood changes or any other symptom or condition.
The Service does not provide medical advice, diagnosis, treatment or an individual medical risk assessment.
Do not rely on the Service as a substitute for professional medical advice, diagnosis or treatment, and do not delay seeking care because of anything shown on Weathera. Always follow advice and treatment plans given by a qualified healthcare professional. If you think you may have a medical emergency, contact the appropriate emergency service immediately.
4. Accuracy and automated signals
Weather and air-quality data may be incomplete, delayed, revised, unavailable or inaccurate. Conditions may vary within the same city.
Weathera may use automated rules, statistical methods and general scientific or editorial information to create weather-related wellbeing signals. These signals describe general associations and are not individual predictions.
No forecast, observation, chart, signal, summary, general explanation or other content is guaranteed to be accurate, complete, current or suitable for a particular decision. Check authoritative local sources and use your own judgment before making decisions.
5. Responsible use
The Service is intended for a general audience. Children should use the Service with the involvement of a parent or legal guardian.
You agree not to misuse the Service, including by attempting unauthorised access; interfering with its operation or security; introducing malicious code; scraping or sending automated requests at a level that burdens the Service; misrepresenting Weathera content; using the Service unlawfully; or using the Service to harm another person.
You are responsible for losses directly caused by your unlawful use of the Service or intentional interference with its operation, to the extent permitted by applicable law.
6. Intellectual property and permitted sharing
Weathera claims rights only in its own code, design, text, graphics, branding, original calculations, structure and presentation. Weather, air-quality and other third-party data remain subject to the rights of their respective providers.
You may share links to the Service and quote brief excerpts for informational, educational, journalistic or commentary purposes, provided that you identify Weathera as the source and do not misrepresent the content.
You may not reproduce, republish, sell, sublicense, systematically extract or commercially exploit a substantial part of the Service without prior permission, except where applicable law permits it.
7. Third-party data and attribution
Certain weather and air-quality information may be provided using third-party data services. Third-party content remains subject to the applicable provider terms, attribution requirements and usage restrictions. Where required, Weathera displays source attribution next to the relevant data.
Use of Google Maps Platform data is also subject to the Google Maps Platform Terms of Service and Google Privacy Policy.
Links to external websites are provided for convenience and reference. We do not control, endorse or assume responsibility for external content, security, availability or privacy practices. Your dealings with a third party are between you and that third party.
8. Availability and changes to the Service
We may change, suspend or discontinue any part of the free Service at any time. We do not guarantee uninterrupted availability, continued support for any location or feature, or correction of every error. We may restrict access when reasonably necessary to protect the Service, users or third parties, or to comply with law.
9. Disclaimers and liability
To the extent permitted by applicable law, the Service is provided free of charge, “as is” and “as available”. We do not guarantee that the Service will always be available or error-free, or that its forecasts, observations, signals, summaries or other content will always be accurate, complete, current or suitable for a particular purpose.
To the extent permitted by applicable law, Weathera is not liable for loss resulting from reliance on inaccurate, incomplete, delayed or unavailable weather, air-quality or wellbeing information, or from using the Service for medical, emergency, safety-critical, commercial, insurance, navigation or similar decisions.
Weathera is not liable for indirect or consequential loss that was not reasonably foreseeable.
Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, personal injury or any other liability that cannot lawfully be excluded or limited. Mandatory rights and consumer protections remain unaffected.
10. Changes, applicable law and contact
We may update these Terms to reflect changes to the Service, data sources, law, security practices or operating model. Changes apply prospectively from the effective date shown at the top of the updated Terms. They do not retroactively change rights or liabilities that arose before that date. If you do not agree with an updated version, stop using the Service.
These Terms are subject to the laws that mandatorily apply to the Service and its users. Any dispute may be brought before a court having jurisdiction under applicable mandatory law. Mandatory consumer protections remain unaffected.
These Terms constitute the agreement governing use of the Service. The Privacy Policy separately describes Weathera’s privacy practices. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A delay in enforcing a provision is not a waiver.
